Am I Eligible for Chapter 7 Bankruptcy in Florida?

The first step in filing for bankruptcy in Florida is determining your eligibility through the “Means Test.” This test compares your household’s average gross income over the last six months (annualized) against the Median Income for a Florida household of your size.

Below Median Income

If your income is below the limit shown above, there is a “presumption of no abuse.” You typically qualify for Chapter 7 bankruptcy automatically regarding income levels.

Above Median Income

Being above the median does not automatically disqualify you. It simply means your attorney must perform the full Means Test calculation, deducting allowable expenses (mortgage, taxes, healthcare) to see if you have disposable income left over.

Income Limits for Cases Filed On or After Nov 1, 2025

The Department of Justice updates these figures approximately every six months. The calculator above uses the Florida data effective for the period beginning November 1, 2025.

Note on Household Size: Your household includes you, your spouse (even if not filing), and dependents you financially support. Roommates are generally not included unless you pool finances.
